Limitation of Liability

Scope of Services and Limitations of Liability

Lucidity Health, LLC ("Provider") will provide the following services in connection with the Galleri® multi-cancer early detection test: (1) administration of the blood draw specimen collection; (2) review and disclosure of test results to the patient; and (3) provision of results to the patient's primary care provider upon written request from the patient.

Limitations of Services. Provider will NOT provide referrals, diagnostic imaging orders, treatment planning, diagnostic interpretation beyond result disclosure, or follow-up care of any kind. The patient acknowledges and agrees that they are solely responsible for coordinating all follow-up care, including but not limited to consultations, diagnostic workups, and treatment, with their primary care provider or appropriate specialist(s).

Test Limitations and Patient Acknowledgment. The patient understands and acknowledges the following:

The Galleri® test is a screening tool only and is NOT diagnostic of cancer. A positive or "cancer signal detected" result does not constitute a cancer diagnosis. False-positive results may occur, meaning the test may indicate a cancer signal where no cancer is present. False-negative results may also occur, meaning the test may fail to detect an existing cancer. Additional follow-up testing, which may include imaging, biopsies, or other diagnostic procedures, may be necessary and may ultimately confirm a false-positive result.

Limitation of Liability. Lucidity Health, LLC, its owners, employees, and agents shall not be held responsible or liable for: (a) the accuracy or reliability of the Galleri® test results, which are processed and reported by a third-party laboratory; (b) any costs, expenses, or financial obligations incurred by the patient as a result of follow-up testing, diagnostic procedures, or specialist consultations; (c) any emotional distress, psychological impact, or mental anguish arising from test results, whether accurate or inaccurate; or (d) any adverse outcomes resulting from the patient's decision to pursue or not pursue follow-up care based on the test results.

The patient acknowledges that they have read, understand, and voluntarily agree to the terms set forth herein.
